Аннотация

Рассмотрены вопросы системы сдержек и противовесов применительно к уголовному процессу в Кыргызской Республике, анализируются роль и место органов прокуратуры в системе государственных органов при осуществлении уголовного преследования. Изложена критика идеи отделения следствия от государственного обвинения, в том числе необоснованность и ущербность для Кыргызской Республики создания так называемого Следственного комитета. Обосновывается необходимость сохранения за прокуратурой ряда процессуальных полномочий по возбуждению уголовных дел, а также наделения прокуратуры полномочием надзора за исполнением законов гражданами по аналогии с высшим надзором прокуратуры в СССР
