Abstract

The article examines implementation of spousal rights in relation to their marital property, specifically analyzing the legal provisions in family legislation of the Kyrgyz Republic and requirement for mutual consent in transactions involving their joint property. The grounds under which such consent is presumed are described, as well as under which it must be expressed either in person, being present at the transaction directly, or in writing with mandatory notary certification. To ensure a comprehensive study, the judicial practice presented in judicial acts of the Supreme Court of the Kyrgyz Republic regarding disputes related to a spouse's expression of consent or lack thereof when the other spouse takes actions to dispose of their joint property was analyzed
